Terms of Use (EULA)

1. Agreement to Terms

By downloading, installing, accessing, or using the RentSmith mobile application ("App") or related services (collectively, the "Service"), you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these terms, do not download, install, or use the Service.

2. Description of Service and Disclaimer of Intermediary Role

RentSmith is a property management and organizational tool designed to assist landlords in tracking rental units, lease terms, payment schedules, and move-in/move-out property inspections, as well as enabling tenants to view their rental details and inspection records.

Crucial Disclaimers:

• No Real Estate Brokerage: RentSmith is not a real estate agency, broker, escrow agent, or legal advisor.
• No Direct Money Handling: RentSmith does not process or transmit rental payments between landlords and tenants. All recorded payments in the app represent administrative records logged by the users.
• No Party to Leases: RentSmith is not a party to any rental agreements, lease contracts, or verbal agreements made between landlords and tenants. Users are solely responsible for ensuring their leases comply with local rental laws and housing regulations.

3. User Accounts and Responsibilities

• Eligibility: You must be at least 18 years old to create an account and use the Service.
• Account Security: You are responsible for safeguarding your login credentials and for all activities that occur under your account.
• Accurate Information: You agree to provide accurate and complete information regarding apartments, lease dates, and inspection reports.
• Prohibited Content: You agree not to upload any unlawful, defamatory, infringing, or harmful photos or content into the app.

4. Subscriptions and In-App Purchases (Apple StoreKit)

RentSmith offers paid subscription plans and purchases for landlords to unlock additional apartment management capabilities:

A. Available Plans

• 1 Apartment Plan: Auto-renewable monthly subscription enabling management of 1 active rental apartment.
• Unlimited Plan: Auto-renewable monthly subscription enabling management of unlimited rental apartments.
• Lifetime Access: One-time non-consumable purchase granting permanent unlimited management capabilities.

B. Payment & Billing Terms (Apple In-App Purchases)

• Charging: Payment will be charged to your Apple ID Account at confirmation of purchase.
• Auto-Renewal: Auto-renewable subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
• Renewal Cost: Your account will be charged for renewal within 24 hours prior to the end of the current period at the original subscription price.
• Managing Subscriptions: You can manage or cancel your auto-renewable subscriptions at any time in your Apple ID Account Settings after purchase (Manage Apple Subscriptions).
• Refunds: All purchases and refunds are processed directly by Apple in accordance with Apple's standard App Store terms and refund policies.

5. Intellectual Property

The Service, including software code, UI design, logos, and graphics, is the intellectual property of RentSmith and is protected by copyright and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the app for personal or internal business rental management.

6. Termination and Account Deletion

You may terminate this agreement at any time by deleting your account within the app (Settings > Delete Account) and uninstalling the application. We reserve the right to suspend or terminate access to the Service for any user who violates these Terms or engages in fraudulent behavior.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RENTSMITH, ITS DEVELOPERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF RENTAL INCOME, DATA LOSS, PROPERTY DAMAGE, OR DISPUTES BETWEEN LANDLORDS AND TENANTS, ARISING FROM YOUR USE OF THE SERVICE.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction, without giving effect to any principles of conflicts of law.
